Personal data is any information that enables us to identify you, and more generally any information relating to an identified individual or an individual who can be identified directly or by cross-referencing with other information. In the course of its business, EFFINITY (a simplified joint stock company registered with the Paris Trade and Companies Register under no. 432 831 550, whose registered office is located at 85, rue Compans, 75019 Paris) may collect and process personal data about you. The present Privacy Policy details the conditions of such processing. This Privacy Policy applies to :

  • persons browsing EFFINITY websites
  • persons using EFFINITY’s services
  • people who visit EFFINITY’s partners’ websites and whose browsing data is tracked by EFFINITY.

The processing of your personal data is the subject of processing sheets which are included in EFFINITY’s register of processing activities.

II. Data collected and purpose

a. Data collected from persons browsing EFFINITY websites

EFFINITY collects and processes data from people who visit the following website:

It then acts as data controller within the meaning of the regulations.
This data is kept confidential and is intended exclusively for our company.

i. Data entered on collection forms
We process the data that you voluntarily communicate by filling in the collection forms on our sites.
This data includes :

  • identification data (surname, first name)
  • contact details: telephone number, e-mail address, business address
  • company name, function and website address

This data is used to respond to your requests and in particular :

  • download white papers and other documentation
  • demo request
  • information request
  • newsletter registration

Data is also used for administrative and internal purposes. b. Data collected from persons using EFFINITY’s services

EFFINITY offers the following services:

  • Affiliation: bringing together advertisers who wish to run advertising campaigns and partners (affiliates) who relay these campaigns in return for payment.
  • Influence: bringing together advertisers who want to promote a product or brand and partners (influencers) who promote it using different methods: photo, video, text, article…
  • Martech (or Effinity Marketing Technologies): white-label, SaaS-mode provision of the platform developed by EFFINITY, enabling advertisers to manage their affiliates directly.
  • Social Ads: purchase of advertising space on social networks and management of advertising campaigns on behalf of the advertiser, with the provision of a platform for measuring campaign performance.

When you create an account as an advertiser or partner, EFFINITY collects the following data:

  • Name
  • First name
  • Company name
  • Website address
  • Postal address
  • Email
  • Phone number
  • Siret
  • Intra-Community VAT number
  • IBAN

EFFINITY then acts as data controller. This data is kept confidential and is intended exclusively for our company. This data is used solely to provide the services offered, for commercial prospecting purposes in compliance with applicable regulations, and for administrative and internal purposes.

c. Data collected from visitors to EFFINITY’s customer and partner websites

As part of affiliation services, Influence and Social Ads, EFFINITY collects, via its Tracking Tool, information relating to navigation and actions performed by users who visit the sites of advertisers or EFFINITY partners through the placement of cookies. This information is collected in order to monitor the performance of advertising campaigns and to calculate the remuneration owed by advertisers to partners and EFFINITY. Specifically, we store cookies on the devices of users who visit the websites of EFFINITY’s advertisers and partners. These cookies enable us to understand which partner has sent a user to an advertiser’s website, so that the latter can acquire more traffic. We measure the success of these referrals and assist in the payment of commissions due to partner websites. Cookies also record commercial transactions carried out on advertiser websites (newsletter registration, request for quotation; order in an online store). The sole purpose of these tracking cookies is to attribute advertising relayed by an affiliate to a commercial transaction carried out on an advertiser website, to calculate the corresponding commissions and to invoice these commissions. In this context, EFFINITY only processes pseudonymized personal data (i.e. an identifier that does not allow EFFINITY to directly identify the Internet user traced with the data it has). For affiliation services, EFFINITY, the advertiser and the partner act as joint data processors. All three are recipients of personal data. III. Recipient

EFFINITY reserves the right to transfer your personal data to its subsidiaries and / or service providers and / or subcontractors and / or partners if this is necessary for the proper conduct of operations or for internal management purposes and in compliance with the purposes mentioned. EFFINITY may also transmit your personal data to the competent authorities in order to comply with its legal and regulatory obligations. Subject to your prior consent, this data may also be transferred to partners for the purposes of analysis, surveys and commercial operations.

IV. IAB Transparency and Consent Framework

Effinity is a registered member of the IAB Transparency and Consent Framework 2.2 (Vendor ID 402) and complies with the guidelines prescribed for this Framework.

V. Transfer outside the EU

EFFINITY may transfer data outside the European Union in the course of its business. Measures have been taken to guarantee the security of transfers, through the signature of specific contractual clauses and reinforced controls carried out by Effinity.

VI. Safety & Security.

We implement all necessary security measures to protect EFFINITY and our users against unauthorized access, modification, disclosure or destruction of the data we hold.

VII. Shelf life

EFFINITY undertakes to keep your personal data for a period not exceeding that strictly necessary for the purposes for which they are processed.
In addition, EFFINITY keeps your personal data in accordance with the retention periods imposed by applicable laws in force.

VIII. Your rights

You have a number of rights concerning your personal data and its processing. You are entitled to:

  • to know what personal data we hold about you and, if necessary, to obtain a copy (right of access);
  • request that we correct any errors in your personal data (right of rectification);
  • to demand that we delete certain data in particular circumstances and if we have no reason to continue processing (right to deletion);
  • request that we disclose your personal data to you or to another service provider in a simple and structured format (right to portability);
  • to object at any time to the processing of your personal data for direct marketing or, more generally, profiling purposes;
  • to object, in other circumstances, to the further processing of your personal data (right of objection);
  • ask us to limit or stop the processing of your personal data in certain circumstances (right to restriction);
  • to give instructions concerning the storage, deletion and communication of your personal data after your death and to choose whether or not we communicate your data to a third party designated by you.

In the event of your death and in the absence of any instructions from you, we undertake to destroy your data, unless its retention proves necessary for evidential purposes or to meet a legal obligation.
